This is the review of a book by Paula Byrne on Lord Mansfield's great-niece, Dido, whom he raised as his own daughter. Lord Mansfield was the Lord Chief Justice of England in the Eighteenth Century. The child was brought to him as an infant and grew up to become what we would today term his paralegal clerk in his Library at Kenwood House. His great-niece was the child of a black slave and his sister's son, Sir John (...) Lindsay. This is also a narrative of the British Slave trade including some of Lord Mansfield's judgements at the King's Bench Division, Royal Courts of Justice. (shrink)

We describe two unusual cases of cardiopulmonary death in mechanically ventilated patients in the neurological intensive care unit. After cardiac arrest, both patients were pulseless for a protracted period. Upon extubation, both developed agonal movements (gasping respiration) resembling life. We discuss these cases and the literature on the ethical and medical controversies associated with determining time of cardiopulmonary death. We conclude that there is rarely a single moment when all of a patient’s physiological functions stop working at once. This can (...) pose a challenge for determining the exact moment of death. We are printing, by kind permission of the Law Commission, two sections of the report of the Law Commission on injuries to unborn children. This report was the result of a request to the Law Commission by the Lord Chancellor at the time (Lord Hailsham of Saint Marylebone) to advise on `what the nature and extent of civil liability for antenatal injury should be'. The Law Commission followed its usual practice in such circumstances of consulting various bodies and (...) obtaining expert advice on the subject and then embodying the results in a working paper (Working Paper No. 47 - injuries to unborn children) published on 19 January 1973, which preceded their report (Cmnd 5709). Meanwhile a Royal Commission is considering much wider issues of civil liability for injury (including antenatal injury) but the terms of reference for the Law Commission were much narrower and confined to the position of children injured before birth. In the section relating to the present law the report makes it clear that it is probable that liability under the common law already exists. The Scottish Law Commission has also issued a report (Cmnd 5371). They were given different terms of reference and came to somewhat different conclusions. We are printing from this long report the paragraphs discussing the medical background and the summary of recommendations. As will be evident on reading the paragraphs on the medical background to injuries to the unborn child, events are moving very rapidly, particularly in the study of congenital defects and the effects of drugs but the problems of proof present great difficulty. Other causes of injury to the unborn child are better known to the general public: for example, those following the illness, infection and disease of the mother during pregnancy, injury caused in attempted termination of pregnancy and the risks resulting from the mother's condition. The summary of the recommendations sets out very clearly the legal position of the unborn child, as the Law Commission sees it, arising from injury before birth, the final conclusion being that `legislation is desirable'. These extracts from the report, apart from their intrinsic interest, lead on to the paper by Mr Kennedy and Dr Edwards in which they set out their criticisms of it, and provide quick references to the original document. The author relates how she asked the spiritual director of a Tibetan centre (...) in Honolulu whether he thought it was a good idea to donate one’s organs at the time of death. He immediately replied in the affirmative. When asked if the removal of the organs would disturb the dying process, he responded that it would be okay since the doctors could “wait for a few days.” On being informed that the organs had to be removed immediately to save the life of the recipient he “expressed alarm” and changed his mind, advising that for an ordinary Buddhist practitioner organ donation might not be advisable after all (p. 160).The fact that Tibetan lamas are giving ethical advice on organ donation without even a layman’s knowledge of the medical procedures involved suggests that Buddhist teachers have a lot to learn about adapting traditional teachings to modern contexts. If the problem were simply that many lack scientific knowledge, this could probably be resolved in the short to medium term. The deeper problem, however, is that Buddhism as a tradition lacks the ethical infrastructure needed to address moral dilemmas, particularly those of the complex kind presented by contemporary scientific and medical developments. Despite their undoubted acumen in certain branches of philosophy (notably metaphysics), Buddhist thinkers of the past have consistently failed to probe the moral foundations of their teachings or to establish a theoretical foundation in terms of which moral dilemmas can be analyzed. Not a single treatise on moral philosophy was produced by any of the classical scholars cited in this volume as authorities. Not surprisingly, the legacy of this neglect is that the voice of Buddhism has been almost completely silent with respect to the kinds of ethical issues addressed in this book.The present work commendably seeks to remedy this absence of information on Buddhist bioethics. This is only the second book ever to attempt such a task, the first being my Buddhism and Bioethics, published over ten years ago in 1996 (reissued by Palgrave in 2002). In the intervening period there have been many scientific [End Page 157] advances, such as cloning and genetic engineering, both of which receive attention in the volume under review. While my own approach sought to build bridges by translating Buddhist concepts into the vocabulary of contemporary bioethics, the present volume holds more tightly to the traditional teachings of Tibetan Buddhism. Accordingly, while the concepts and terminology used will be familiar to those inside the tradition, I am not sure to what extent it will facilitate dialogue with bioethicists and clinicians, for whom the colorful and somewhat medieval facets of these teachings may at times seem esoteric.Before discussing the ethical issues further, it should be pointed out that less than half of the book (chapters 8–11) is devoted directly to bioethics. The first seven chapters are for the most part an account of topics in Mahayana philosophy (such as no-self, dependent origination, and emptiness) and descriptions of the beliefs and practices of Tibetan Buddhism surrounding death. These include meditational practices relating to death and the notion of the post-mortem intermediate state (bardo). Somewhat oddly, chapter 5, titled “Foundations of Buddhist Ethics,” has almost nothing to say about ethics: after a short but potentially interesting section titled “Buddhist Definitions of Life and Death,” it veers off into a lengthy summary of Madhyamaka, Vijnanavada, and Tathagatagarbha doctrines.Tibetan teachings about death have been summarized in numerous popular volumes in recent years, and it is unclear why such an extended treatment of them is presented again here. The opening sentence of chapter 8 suggests this was necessary to “set the stage for an exploration of bioethical issues from Buddhist points of view,” but the bulk of this material has little connection with bioethics. While perhaps best known for his Lives, Plutarch also wrote philosophical dialogues that constitute a major intellectual legacy from the first century A.D. This collection presents two important short works from his writings in moral philosophy. They reveal Plutarch at his best--informative, sympathetic, rich in narrative--and are accompanied by an extensive commentary that situates Plutarch and his views on marriage in their historical context.

A formalism is developed which admits particles faster than light and reference frames faster than light and as fast as light. It is fully consistent with the physical principles of special relativity. The necessity of introducing imaginary quantities does not arise. It does not encounter any difficulties with the principle of causality if it is reasonably interpreted.

Strategies that motivate agrifood producers to adopt more sustainable practices are a critical component for a sustainable future. This case study examines farmer attitudes to a recently released New Zealand agricultural policy aimed at improving freshwater quality by restricting agricultural activities. Our study interprets interviews of nine individuals managing a range of dairy and sheep farming operations to explore how these farmers manage societal expectations of being a ‘good farmer’ in the context of the new regulations. Four themes were developed (...) to capture perceptions of participants: the vested interest of farmers in positive community engagement and being seen as a ‘good’ farmer; the need to manage farms prudently for future generations; the unique geographical and environmental conditions on each farm and their concerns about the lack of acknowledgment of differences across land types in New Zealand; and the unintended consequences of the new regulations for rural communities. Overall, the themes suggest that the way the policy was enacted conflicts with perceptions of a ‘good farmer’ and good farming practice, resulting in identity conflicts for the farming community and reduced motivation to adopt alternative practices. Machiavelli's New Modes and Orders is the only full-length interpretive study on Machiavelli's controversial and ambiguous work, Discourses on Livy. These discourses, considered by some to be Machiavelli's most important work, are thoroughly explained in a chapter-by-chapter commentary by Harvey C. Mansfield, one of the world's foremost interpreters of this remarkable philosopher. Mansfield's aim is to discern Machiavelli's intention in writing the book: he argues that Machiavelli wanted to introduce new modes and orders in political philosophy in order to make (...) himself the founder of modern politics. Mansfield maintains that Machiavelli deliberately concealed part of his intentions so that only the most perceptive reader could see beneath the surface of the text and understand the whole of his book. Hardy’s non-locality paradox is a proof without inequalities showing that certain non-local correlations violate local realism. It is ‘possibilistic’ in the sense that one only distinguishes between possible outcomes (positive probability) and impossible outcomes (zero probability). Here we show that Hardy’s paradox is quite universal: in any (2,2,l) or (2,k,2) Bell scenario, the occurrence of Hardy’s paradox is a necessary and sufficient condition for possibilistic non-locality. In particular, it subsumes all ladder paradoxes. This universality of Hardy’s paradox is not true (...) more generally: we find a new ‘proof without inequalities’ in the (2,3,3) scenario that can witness non-locality even for correlations that do not display the Hardy paradox. We discuss the ramifications of our results for the computational complexity of recognising possibilistic non-locality. (shrink)

The book tells the story of Dido's life in Lord Mansfield homes, from the time her father begged Lord and Lady Mansfield to be wards of the child Dido to the death at age 88 of Lord Mansfield, mainly cared for by Dido and to Dido's young death at age (...) 43. Errol Lord explores the boundaries of epistemic normativity. He argues that we can understand these better by thinking about which mental states are competitors in rationality’s competition. He argues that belief, disbelief, and two kinds of suspension of judgment are competitors. Lord shows that there are non-evidential reasons for suspension of judgment. One upshot is an independent motivation for a certain sort of pragmatist view of epistemic rationality.

The global musical subject is thus defined and framed within global empires and techno‐culture in ways not unrelated to political interests. ‘Being musical’ becomes a critical issue. The New Zealand music curriculum resonates with reflections of global ‘progress’, and music educators, as cultural workers, therefore require an awareness of political and strategic conceptions of musical knowledge as well as a familiarity with the discourses through which the work of (...) music education is enframed. Where technology enters hegemonic discourses of musical knowledge, the relationship between global communication and technology requires interrogation, and unquestioned past and present curriculum ‘certainties’ come under scrutiny. You are irrational when you are akratic. On this point most agree. Despite this agreement, there is a tremendous amount of disagreement about what the correct explanation of this data is. Narrow-scopers think that the correct explanation is that you are violating a narrow-scope conditional requirement. You lack an intention to x that you are required to have given the fact that you believe you ought to x. Wide-scopers disagree. They think that a conditional you are required to make true (...) is false. You aren’t required to have any particular attitudes. You’re just required to intend to x or not believe you ought to x. Wide-scope accounts are symmetrical insofar as they predict that you are complying with the relevant requirement just so long as the relevant conditional is true. Some narrow-scopers object to this symmetry. However, there is disagreement about why the symmetry is objectionable. This has led wide-scopers to defend their view against a number of different symmetry objections. I think their defenses in the face of these objections are, on the whole, plausible. Unfortunately for them, they aren’t defending their view against the best version of the objection. In this paper I will show that there is a symmetry objection to wide-scope accounts that both hasn’t been responded to and is a serious problem for wide-scope accounts. Moreover, my version of the objection will allow us to see that there is at least one narrow-scope view that has been seriously underappreciated in the literature. (shrink)

Insurance law in the eighteenth century is often seen as a perfect illustration of the way commercial law emerged from a relationship between the judges and the merchants, with Lord Mansfield at the centre, drawing on mercantile custom. This view tends to subordinate the role of both the merchants and Parliament. Yet, merchants were involved in shaping the law not just as witnesses and jurors in Mansfield’s court, but also through their promotion of, and opposition to, legislation, and through (...) the ways in which business was conducted and disputes were resolved. One reason that Gramsci's writings are becoming ever more studied in the English-speaking world is their non-reductive approach. Today, the fact that a general theory of language informs Gramsci's Prison Notebooks is increasingly being recognized. While some parts of the writings on language have been translated into English, so far only the Italian editions have allowed an evaluation of the significance and role of linguistic issues in Gramsci. The following will seek to reconstruct the connections between die theory of language (...) and the more familiar elements of Gramsci's thought. In this thesis I provide an interpretation of Kant's theories of knowledge, nature, and being in order to argue that Kant's ontology is a productive ontology: it is a theory of being that includes a notion of production. I aim to show that Kant's epistemology and philosophy of nature are based on a theory of being as productivity. The thesis contributes to knowledge in that it considers in detail Kant's ontology and theory of being, topics which have generally been ignored (...) or misunderstood. In arguing for Kant's productive ontology, I argue against Heidegger's interpretation of Kant, which states that Kant understands being as "produced permanent presence" or as divinely created materiality. Based on Kant's definition of being as positing, I argue, by contrast to Heidegger, that Kant understands being as the original productive relation between subject and object. This can also be expressed as the relation between formality and materiality, or between epistemic conditions and existence, that is productive of objects of experience. Being is not producedness but a relation of productivity, through which both subject and object are themselves productive. The subject is productive in its spontaneity, and nature, determined as dynamical interaction, is interpreted as productive. The subject, I will argue, does not understand nature as produced, but approaches it with a comportment towards its production as object of experience. Because of its own subjective productivity - spontaneity or "life" - the subject has a "productive comportment" towards nature. Ontology, I claim, concerns the realm of the productive relation of being, the realm of the relation between epistemic conditions and existence, and therefore the realm of possible experience. This marks Kant as divergent not only from what Heidegger calls "the ontology of the extant", but also from the concept-based ontology of the German rationalists. The general aims of the thesis are, first, to argue that being for Kant is the original relation between subject and object, and that ontology concerns this relation; second, to argue that ontology and being are understood in terms of production and productivity; and third, to argue that Heidegger is wrong to ascribe to Kant an understanding of being as "produced pennanent presence". I approach these aims by examining a number of Kant's texts in detail, focusing particularly on Kant's theses about existence and being in The One Possible Basis for a Demonstration of the Existence of God and the Critique of Pure Reason; on Kant's philosophy of nature and dynamical matter in the Transcendental Analytic and Metaphysical Foundations of Natural Science; on Kant's doctrine of experience and objectivity in the Transcendental Deductions; on ontological reflection and the productive comportment of "life" in the Critique of Judgment; and on Kant's final theory of matter, life and production in the Opus Postumum. This paper attempts to provide, through a reading of Derrida's Rogues, an account of the political phenomenon where regimes of sovereignty are resisted in the name of the very values — freedom, democracy and human rights, for example — they purport to stand for. To Derrida, sovereignty must simultaneously conform to a logic of both self-identity and of unconditionality. However, the unconditionality that makes sovereignty possible will always threaten and exceed it, something that other accounts like Agamben's try implicitly to (...) deny. In the end, for Derrida, our present political challenge is to recognize, and even affirm, the way the unconditionality of sovereignty is turned against itself. Sovereignty, then, is most effectively dealt with not by imagining a world in which it will no longer occur, nor by simple opposition, but by committing to the very logic of sovereignty itself. Ethical guidance for genomic research is increasingly sought and perceived to be necessary. Although there are pressing ethical issues in genomic research – concerning for example the recruitment of patients/participants; the process of taking consent; data sharing; and returning results to patients/participants – there is still limited useful guidance available for researchers/clinicians or for the research ethics committees who review such projects. This report outlines the ethical principles and guidance for genomic research co-produced with stakeholders during two workshops which took (...) place in the UK between November 2016 and May 2017. The stakeholders involved in these workshops included: healthcare professionals, genomic research teams, academics, patients, biobank managers, and representatives from the Health Research Authority, NHS Research Ethics Committees, patient support groups, pharmaceutical industry, and health policy think tanks. Derrida's work on hospitality presents particular local conventions of hospitality as in a necessary but impossible relationship with an absolute hospitality, the obligation to welcome the other without conditions. Although this absolute hospitality is commonly read as the aspiration to which all of our practices of hospitality should tend, Derrida proposes a series of examples that show the dangers implicit in an automatic or limitless welcoming. The most famous of these is that of the Old Testament patriarch, Lot. The aim (...) of this paper is to show, however, that the Genesis story is not primarily a parable about correct and incorrect practices of hospitality. In fact, what is at stake in the visit of the angels to Lot is the covenant between Abraham's line and the divine and the coming into the world of God's absolute sovereign violence. Derrida's account of hospitality is thus part of his discussion of sovereignty, its limitlessness, force and danger. (shrink)

SummaryIn An Essay upon Civil Government (1722), Andrew Michael Ramsay mounted a sustained attack upon the development throughout English history of popular government. According to Ramsay, popular involvement in sovereignty had led to the decline of society and the revolutions of the seventeenth century. In his own time, Parliament had become a despotic instrument of government, riven with faction and driven by a multiplicity of laws that manifested a widespread corruption in the state. Ramsay's solution to this degeneracy was the (...) extirpation of Parliament, and its substitution with a monarchy moderated by an aristocratic senate. Ramsay's adoption of certain “Country” elements, including a return to the first principles of the constitution, claimed to reflect the principles of contemporary French aristocratic theory which called for the reform of government through the nobility. In his desire to exclude popular government, and reverse the decline of the state, however, Ramsay utilised the theory with which Bossuet had defended Louis XIV's absolute France. Intriguingly, traces of the natural law system which fortified Ramsay's theory can be found in Viscount Bolingbroke's subsequent attack on Walpole's Whig ministry and the corruption of the state.
